1. Agreement

By creating an account or using SmartCam Alerts ("Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service. Simple as that.

We may update these Terms from time to time. Continued use after changes means you accept them. We'll notify you of material changes via email.

2. The Service

SmartCam Alerts provides AI-powered camera monitoring. Here's what that means:

• You connect your existing cameras via the SmartCam Bridge app
• The Bridge captures snapshots and sends them to our cloud
• Our AI (powered by Google Gemini Vision) analyzes snapshots against your alert rules
• You receive notifications when your rules are triggered

3. Your Account

• You must provide a valid email address
• You're responsible for keeping your password and API keys secure
• You're responsible for all activity under your account
• One person per account (no sharing credentials)
• You must be at least 18 years old

4. Acceptable Use

You agree to use SmartCam Alerts only for lawful purposes. Specifically:

You May

• Monitor your own property (home, business, farm, etc.)
• Set up alerts for security events (intrusions, deliveries, wildlife)
• Use the API to integrate with your own systems
• Monitor cameras you own or have explicit permission to access

You May Not

• Monitor people without their knowledge or consent where legally required
• Use the Service for stalking, harassment, or surveillance of individuals
• Monitor areas where people have a reasonable expectation of privacy (bathrooms, bedrooms of others, etc.)
• Use the Service to violate any local, state, or federal law
• Attempt to reverse-engineer, exploit, or attack the Service
• Share your account or API keys with unauthorized parties
• Use the Service to generate, store, or distribute illegal content
• Exceed your plan's camera or usage limits through technical workarounds

5. Plans & Billing

• Paid plans are billed monthly via Stripe
• You can cancel anytime — your plan stays active until the end of the billing period
• No refunds for partial months (you keep access until the period ends)
• We reserve the right to change pricing with 30 days' notice
• Free plan may have rate limits on snapshot processing

6. Your Data & Content

• You own your camera snapshots and data
• You grant us a limited license to process, store, and analyze your snapshots solely to provide the Service
• We do not claim ownership of your content
• You can delete your data at any time via the dashboard

7. AI & Alert Accuracy

• AI analysis is provided on a "best effort" basis
• False positives and false negatives will occur — AI isn't perfect
• Detection accuracy varies based on lighting, camera quality, and scene complexity
• We do not guarantee real-time alert delivery — network delays can occur
• You should not rely solely on SmartCam for life-safety or critical security situations
• We are not liable for missed detections or false alarms

8. Service Availability

• We target high availability but don't guarantee 100% uptime
• Maintenance windows will be communicated when possible
• Third-party outages (Cloudflare, Google, Stripe) are outside our control
• The Bridge app requires your local device to be running and connected to the internet

9. Limitation of Liability

To the maximum extent permitted by law:

• SmartCam Alerts is provided "as is" without warranty of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you've paid us in the past 12 months
• We are not liable for losses caused by missed alerts, false alerts, or service downtime
• We are not responsible for unauthorized access to your cameras due to your own security practices

10. Termination

• By you: Cancel anytime from the dashboard or by emailing us
• By us: We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted within 30 days
• We may retain anonymized, aggregated usage data for analytics

11. Intellectual Property

The SmartCam Alerts name, logo, website design, and Bridge application are our intellectual property. You may not copy, modify, or redistribute them without permission.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the state where SmartCam Alerts operates.
